President Bush is trying to fool Americans into thinking that Sam Alito is a mainstream judicial nominee, which is why PFAW is committed to exposing the truth about Alito’s record and his judicial philosophy. This ad recounts troubling Alito rulings and legal positions, including his voting to uphold a strip search of a 10-year old girl without a valid warrant, his unsuccessful effort as an appeals court judge to declare a law regulating machine guns unconstitutional, and his declaration while in the Justice Department that the Constitution does not protect a woman’s right to choose an abortion.

The 30-second television spot (also available at IndependentCourt.org) highlights Alito’s extremely troubling record as a federal judge and public official, and reminds viewers that he is the hand-picked candidate of far-right leaders. “The right wing has already taken over the West Wing…don’t let them take over your Supreme Court,” says the ad, which mentions Alito’s efforts as a federal judge to weaken protections against job discrimination, his dissent that would have upheld the strip search of a 10-year-old girl without a valid warrant, and his declaration that the Constitution does not protect a woman’s right to an abortion.

Our first in the Alito nomination reminds the American people how we came to this nomination – a complete capitulation by President Bush to the demands of the radical right of his party. The ad reminds the American people that the right-wing Alito is nominated to replace the far more mainstream conservative Sandra Day O’Connor, the swing vote who safeguarded many of our most precious rights and liberties.
The ad was produced by SDD Media and debuts on “Meet the Press” Sunday, November 6. It will run in local television newscasts and on national cable news in the coming week. We and our coalition partners plan to produce more ads in the coming weeks, reminding Americans of the critical role the Supreme Court plays in our daily lives – safeguarding our liberties, guaranteeing privacy and reproductive choice for women, keeping our air and water clean, upholding health and safety standards for workers, and insuring equal rights and access to justice for every American.
